Terms of Use

The careers job board (“Job Board”) of LGBT Great Limited (“LGBT Great”, “Our” or “Us”) offers a recruitment service to employers and/or recruiters (“Employers” or “You”) seeking to recruit staff (“Potential Candidates”) via vacancies posted onto the Job Board. By posting a vacancy on the Job Board or by providing Us with an advertisement to post on your behalf, Employers will be deemed to have understood and accepted these terms and conditions (“Terms”) which shall constitutes an agreement between You and LGBT Great. You warrant and represent that you have full capacity and authority to enter into these Terms on behalf of yourself or on behalf of the Employer’s company you work for, as applicable.

Our website “lgbtgreatcareers.com” (“Site”) is owned and operated by LGBT Great of Warnford Court, 29 Throgmorton Street, London, England, EC2N 2AT (company no.: 12952838). The Site is intended for use only by Employers and Potential Candidates. By using the Site and the services of LGBT Great in respect of the Job Board, You agree that you will be bound by these Terms. 

The Job Board is an initiative of LGBT Great and Workable Software Limited (“Workable”), Our technology provider. Each Employer acknowledges and agrees that, by entering into these Terms, there is no relationship established between the Employer and Workable, unless the Employer is already a customer of Workable or until they become an active customer of Workable, except as otherwise provided in these Terms. In case an Employer already has an active account with Workable, nothing in these Terms alters their obligations to Workable.


Data Protection

Our use of CVs and other personal information supplied by users of the Site is governed by our privacy policy which can be found on Our website.

Each Employer undertakes full responsibility in relation to the processing of Potential Candidates’ data who apply through the Site for the job postings You have published on the Job Board. For the avoidance of doubt, each Employer is responsible for informing Potential Candidates about the processing by You of their personal information by uploading your Privacy Policy including all necessary information about how You collect and process Potential Candidates’ data.

In respect of any personal data accessed or otherwise processed by an Employer as a result of access to the Site and the Job Board, the Employer agrees that it shall be the sole data controller of such personal data for the purposes of UK GDPA and the Data Protection Act 2018 and, as such, shall be solely responsible for its processing.

We reserve the right to suspend the provision of any of our Job Board services to You in circumstances where We reasonably believe that You have performed any unauthorized processing of information or data.


Use of the Site and Job Board

All Employers agree to deal fairly and professionally and in accordance with the requirements set out in the Employment Rights Act 1996, Equality Act 2010 and any other applicable laws with Potential Candidates who may respond to an advertisement you have posted on the Job Board.

You must not do anything which may bring Us or the Site into disrepute. 

You will indemnify Us from and against any claim brought by any person (be it a Potential Candidate or otherwise) against Us arising from your breach of this obligation or any other term of these Terms.

The information and services available on the Job Board   are provided for the sole purpose of Potential Candidates looking for employment opportunities and for Employers seeking to recruit staff. You may use, copy, print and download information from the Job Board for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the Job Board and if you do or if you perform any unauthorized processing of information on the Site it shall be a deemed a material breach of these Terms which shall entitle Us to terminate our services offered to You immediately on notice in writing from Us. 

In relation to the use of the Job Board LGBT Great is acting purely as a conduit between Employers and Potential Candidates and as such LGBT Great neither endorses, nor makes any representations on behalf of Employers or Potential Candidates. 

LGBT Great reserves the right, in its sole discretion, to refuse to place, remove or edit an advertisement on the Job Board for any reason, including but not limited to if, in Our opinion, it is not in the interests of Potential Candidates, LGBT Great, or is in breach of any of Our other policies. 

LGBT Great hereby excludes any warranties (whether expressed or implied) or any other assurances as to the operation, quality, accuracy, efficacy, completeness, performance, timelessness, or fitness for any particular purpose, or functionality of the Site or the Job Board. Furthermore, it is accepted that access to the Site and the Job Board may be interrupted, restricted or delayed, at any time, for any reason.

By using the Site and the Job Board, each Employer agrees additionally that it shall not:

(i) modify, translate, create or attempt to create derivative copies of or copy the Site or the Job Board in whole or in part;

(ii) take any action that would violate the security of the Site or the Job Board; or 

(iii) reverse engineer, decompile, disassemble or otherwise reduce the object code of the Site or  the Job Board to source code form.


Employment Agencies and Employment Business Regulations 2003

For the purpose of the Conduct of Employment Agencies and Employment Business Regulations 2003 (“Regulations”), We operate as a venue only and are not an employment business and do not introduce or supply work-seekers to hirers (or vice versa). This means that We do not:

  • obtain sufficient information for Employers to select a suitable Potential Candidate for the position which the Employer seeks to fill;
  • obtain confirmation of the identify of any Potential Candidates or that they have the experience, training, qualifications or authorization to work in the position to be filled or that they wish to undertake the role to be filled;
  • take any steps to ensure the Employer and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the Employer to fulfil the position to be filled;
  • take any steps to ensure that it would not be detrimental to the interests of the Potential Candidate for the Potential Candidate to fulfil the position to be filled;
  • give any indication to Employers whether Potential Candidates are unsuitable (or suitable) for any position to be filled in any circumstances;
  • propose Potential Candidates to Employers or provide any information about them; or
  • take up any references in relation to a Potential Candidate.

The Regulations seek to ensure that Potential Candidates are only proposed by employment agencies for roles for which they are properly qualified and that recruiters are only offered Potential Candidates who have the appropriate levels of experience, training, qualifications and authorization for the position to be filled. Since We are only a venue operating a Job Board and do not propose or introduce Potential Candidates to Employers or vice versa, it is recommended that you fully ensure a Potential Candidate’s suitability for the role you are advertising on the Site.


Duties of Employers

You have the ability to publish job openings on the Site, meaning descriptions of an employment role or position that You seek to fill. You agree that You are solely responsible for any content and the URLs you provide.

You accept full responsibility for any job opening posted on the Job Board and for the recruiting decisions You take as a result of any such opening. LGBT Great has no responsibility for any employment decisions made by You in regard to any posting on the Site.

You represent and warrant that your use of the Site and the Job Board, including the job postings submission and any communication with Potential Candidates comply with all applicable laws and legislation and You are solely responsible for any and all content that is posted online.

You shall not at any time transmit or knowingly or recklessly send material which, without limitation, is obscene, threatening, offensive, defamatory, abusive, untrue, in breach of confidence, including racist or sexist content or materials. Additionally, you shall not harass any Potential Candidates or advocate harassment, send unsolicited emails or texts and generally contact individuals that have indicated they don't want to be contacted by You.


Crossposting

You agree that your job postings will be published by default except from the Site, also to the Workable Job Board (https://jobs.workable.com/) (“Third Party Job Board”) and You hereby provide the relevant authorisation to the Third Party Job Board to publish your job postings, unless you decide to opt out from crossposting by contacting [Abbrev]’s administrator or as otherwise indicated via the Services, in which case clause this clause shall not be applicable to You.

You acknowledge also that Candidates will have the option to apply directly on the Third Party Job Board, in which case You agree to receive a copy of the application and Candidates information. Crossposting to the Third Party Job Board, is also subject to the Third Party Job Board Terms (available for review at https://jobs.workable.com/terms) and you hereby agree with such terms.


Liability

To the maximum extent permitted by law, LGBT Great accepts no liability for any loss, damage or inconvenience to an Employer, Potential Candidate or any other Site user, resulting from or in connection with the use of the Site or the Job Board including, without limitation, direct, indirect, special or consequential loss or damage. 

For the avoidance of doubt, liability for fraud, fraudulent misrepresentation, death or personal injury is not excluded. 

The Job Board is provided by LGBT Great on an “as is” basis. LGBT Great makes no representations or warranties in relation to the Job Board, advertising services or to any resources and information provided. 

LGBT Great is not liable for any failure or omission by an Employer to adhere to or comply with any current regulation or legislation applicable to a vacancy or position advertised by an Employer on the Job Board at any time. 

LGBT Great hereby excludes any representations or warranties (whether express or implied) or any other assurances as to the quality, accuracy, efficacy, completeness, performance, timelessness, or fitness for any particular purpose of any of the jobs or content of the material appearing on the Site or the Job Board, including (but not necessarily limited) to any Curriculum Vitae of a Potential Candidate or any description of an Employer which may be contained on the Site or Job Board.

Indemnity

You agree to indemnify, and hold LGBT Great, its affiliates, and their respective officers, directors, employees and agents harmless, from and against any loss, liability, claims, actions or demands, including, without limitation, reasonable legal fees and costs, made by any third party due to or otherwise arising from Your use of the Site and the Job Board, or arising from Your breach of any provision of these Terms, including, without limitation, any intellectual property infringement caused by your content.

Employers must notify LGBT Great immediately upon becoming aware of any third-party claim against them in regard to your use of the Site and the Job Board.


Intellectual Property 

The Site, including all copyright database rights and any other intellectual property in regard to the Site and the Job Board and the material available on the Site, other than advertisements placed by You, is owned by LGBT Great, its licensors or any third-party contributors to the Site used by Us. Use of the Site or the Job Board does not give anyone any proprietary rights in such materials. 

By submitting any information on the Site and/or the Job Board, Employers hereby grant LGBT Great a perpetual, sub-licensable, worldwide, royalty- free license to publish and make available on the Site and the Job Board the Employer’s information, including without limitation their name and logo. Each Employer represents and warrants that they own the content and have the right to grant such licence to LGBT Great, or that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to You the right to grant such a licence. 

Each Employer is solely responsible for any and all data, information or any other content that they upload, post, or otherwise provide or store on the Site and the Job Board and for any damages or harm that may arise to others by the use of your content.



Assignment 

Each Employer agrees additionally that it shall not distribute, sub-license, assign, transfer,  share, timeshare, sell, rent, lease, transmit, grant a security interest in or otherwise dispose of any rights or obligations under these Terms without the prior written consent of LGBT Great.


Variation of these Terms

LGBT Great reserves the right to modify these Terms at any time, by revising them on the Site, provided that any such modifications does not materially change the overall functionality of any services offered or substantially diminish an Employer’s rights and obligations under these Terms. Any changes LGBT Great may make to this document in the future will be notified and made available to each Employer via the Site.


Notices 

Any notices in relation to the use of the Site and the Job Board, including any data deletion requests, shall be addressed to LGBT Great at the following email address: [email protected].


Governing Law

These Terms (including any non-contractual claims or disputes) shall be governed by and interpreted in accordance with the laws of England and any claims, disputes or legal proceedings arising under these Terms (including any non-contractual claims or disputes) shall be subject to the exclusive jurisdiction of the courts of England and Wales .
